1. Acceptance of Terms

By accessing or using adhdaday.com (the "Site") or subscribing to the ADHD a Day service (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not use the Site or Service.

These Terms constitute a legally binding agreement between you and HahaTech LLC ("we," "us," "our," or the "Company"). We reserve the right to update or modify these Terms at any time, and your continued use of the Site or Service after any changes constitutes acceptance of the revised Terms.

2. About the Service

ADHD a Day is a subscription-based service that delivers one daily motivational message ("Spite Fuel") to subscribers via email every morning at approximately 7:00 AM. The Service is designed for adults with ADHD who prefer direct, no-nonsense motivation.

The subscription costs $19.99 per year (annual recurring). The Service includes:

• One daily motivational email delivered every morning
• A welcome email upon subscribing
• Access to the adhdaday.com website

3. Eligibility

You must be at least 18 years of age to use this Site or subscribe to the Service. By using the Site or subscribing, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

We do not knowingly collect personal information from anyone under 18. If we learn that a person under 18 has subscribed, we will promptly cancel their subscription and delete their information.

4. Subscription and Payment

4.1 Subscription

To subscribe to the Service, you complete a purchase through a Stripe-hosted checkout page. No account creation or login is required. You provide your email address, name, and payment information directly to Stripe.

4.2 Pricing

The Service costs $19.99 per year (USD), billed annually. We reserve the right to change pricing at any time, but price changes will not affect active subscriptions until their next renewal date. We will provide at least 30 days' notice before any price increase takes effect on renewals.

4.3 Automatic Renewal

Your subscription automatically renews at the end of each annual billing cycle unless you cancel before the renewal date. You will be charged the then-current subscription fee upon renewal.

4.4 Payment Processing

All payments are processed by Stripe through their hosted checkout page. By making a purchase, you also agree to Stripe's Terms of Service. Your payment card information is collected and processed solely by Stripe and never touches our servers.

4.5 No Refunds

All sales are final. Because the Service is a digital subscription, no refunds, credits, or exchanges are available once payment is processed. See our Refund Policy for full details.

5. Email Communications

5.1 Service Emails

By subscribing, you consent to receive the following emails:

• Welcome email -- sent immediately after subscribing
• Daily motivational message -- sent every morning at approximately 7:00 AM
• Unsubscribe confirmation -- sent when you unsubscribe from emails
• Stripe payment receipt -- sent at purchase and each renewal

5.2 Promotional Emails

We may occasionally send promotional emails about new features, updates, or related content. You may opt out of promotional emails at any time by clicking "unsubscribe" in any promotional email or contacting us at support@hahatech.team. Opting out of promotional emails does not affect your daily messages.

5.3 Unsubscribe vs. Cancel

• Unsubscribe stops your daily emails but keeps your subscription active (you paid for the year).
• Cancel stops your subscription from renewing. You continue receiving emails until the end of your paid period.

6. Cancellation

You may cancel your subscription at any time by:

• Using the "Cancel Membership" link in any email footer (links to Stripe Customer Portal)
• Contacting us at support@hahatech.team

Upon cancellation:

• Your subscription will not renew at the end of the current billing cycle
• You will continue receiving daily emails until the end of your paid period
• Your personal data will be deleted from our active systems upon expiration of the paid period

7. Intellectual Property

7.1 Site Content

The Site's design, layout, logos, graphics, text, daily messages, and all other original content are the property of HahaTech LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and its content for your personal, non-commercial use. You may not:

• Forward, republish, or redistribute daily messages to others
• Use messages for any commercial purpose without our written permission
• Copy, scrape, or systematically download content from the Site
• Remove or alter any copyright or trademark notices

7.3 Trademarks

"ADHD a Day," "ADHDaDay," "Spite Fuel," and related marks are trademarks or service marks of HahaTech LLC. You may not use these marks without our prior written permission.

8. Prohibited Conduct

You agree not to:

• Provide false information during the subscription process
• Share your subscription or forward daily messages to non-subscribers for their ongoing use
• Use automated systems (bots, scrapers) to access the Site or Service
• Attempt to gain unauthorized access to the Site, its servers, or any connected systems
• Interfere with or disrupt the operation of the Site or Service
• Use the Site or Service for any unlawful purpose
• Transmit any viruses, malware, or harmful code

We reserve the right to suspend or terminate access for any user who violates these Terms, at our sole discretion and without prior notice.

9. Disclaimer of Warranties

9.1 Not Medical, Mental Health, or Coaching Advice

IMPORTANT: ADHD a Day is a motivational message service. It is NOT:

• Medical advice
• Mental health treatment, therapy, or counseling
• A substitute for professional psychiatric or psychological care
• Life coaching or professional coaching
• A diagnostic tool for ADHD or any condition

The messages delivered through the Service are for motivational and entertainment purposes only. They are not intended to diagnose, treat, cure, or prevent any medical or mental health condition, including ADHD.

If you have ADHD or any mental health condition, consult a qualified healthcare provider. Do not disregard professional medical advice or delay seeking treatment because of content received through this Service.

9.2 No Guarantees

We do not guarantee that the Service will improve your ADHD symptoms, increase your productivity or motivation, or achieve any specific results. Individual experiences vary.

You agree to indemnify, defend, and hold harmless HahaTech LLC, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Site or Service
• Your violation of these Terms
• Your violation of any rights of a third party

This indemnification obligation survives the termination of these Terms and your use of the Service.

12. Dispute Resolution

12.1 Governing Law

These Terms and any disputes arising from them are governed by the laws of the State of Florida, United States, without regard to its conflict of law principles.

12.2 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at support@hahatech.team and attempt to resolve the dispute informally for at least 30 days.

12.3 Binding Arbitration

If we cannot resolve a dispute informally, you and HahaTech LLC agree that any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Palm Beach County, Florida, or at another mutually agreed location.

Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

13. Termination and Suspension

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice. Reasons for termination may include, but are not limited to:

• Violation of these Terms
• Fraudulent activity
• Conduct that we determine to be harmful to the Service or our business

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including disclaimers, limitations of liability, indemnification, and dispute resolution.

14. Modifications to Terms

We may revise these Terms at any time by posting the updated Terms on the Site. The "Last Updated" date at the top of this page indicates when the Terms were last revised. Your continued use of the Site or Service after modifications constitutes acceptance of the revised Terms.

For material changes, we will make reasonable efforts to notify active subscribers by email.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Refund Policy, and any other legal notices published on the Site, constitute the entire agreement between you and HahaTech LLC regarding your use of the Site and Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
